APEDA Registration

APEDA is the abbreviation for Agricultural & Processed Food Products Export Development Authority. It is an executive organization established in 1985 through an act for the growth and promotion of export of scheduled products. It provides financial assistance, information, guidelines towards the development of scheduled products. The products listed under the APEDA Act are called schedule products, and, the exporters who want to export such scheduled products shall get their self-registered under APEDA.

APEDA in Contribution for Export and Industrial Investments

It also works in the direction to provide financial aid to the scheduled products and at the same time issue guidelines and provide information pertaining to the progress of those products.

In Indian economy, the Agriculture plays a crucial role by contributing to India’s total export and a certain percentage to the total Industrial investment. Uniformly, the agriculture and processed food products industry is progressing in the direction of growth and expansion and it only becomes possible because of the government’s policies.

With the obligation to perform export promotion and development activities of the scheduled products, under the Ministry of Commerce and Industry, the Government of India has established Agricultural and Processed Food Products Export Development Authority.

What are the Documents Required for APEDA Registration in India?

  • Duly signed APEDA application form
  • Copy of Import-Export code issued by D.G.F.T.
  • Bank details and certification duly signed by the authorities.
  • Bank A/c. statement of the account of the firm (for latest 2 months)
  • Canceled cheque.
  • In case of a company, certified copy of MOA, In case of partnership firm, partnership deed is required.

What is the Procedure to obtain the APEDA Registration?

With the view to simply the procedure, the applicant can submit online application using digital signatures. Exporters can apply online by following the requisite steps-

Visit The Website

Visit the APEDA Website, login, and click on "Register as Member".

Provide The Requisite Detail

Provide the requisite details like IE Code, Email ID & Mobile number and then click on the submit button.

Generation Of OTP For Confirmation

One Time Password is required for confirming the details .OPT will be sent on E-mail and mobile number. Click on Submit Button to proceed.

Filing The Application Online

Once verification is done, fill in the online application along with the requisite documents.

Note-The Documents Should Be In The JPEG, PDF, Or PNG Formats Only.

Processing Of Application Form

Online application can be completed in one or more sessions by revisiting the website using the assigned OTP. Also, don’t forget to save the data, once the information is filed in the respective fields. The data entered can be edited until online payment is not made.

Payment Of Requisite Fees

For the APEDA registration, the payment of Rs. 5000/- excluding taxes is required to be made through any of the below-mentioned modes:

  • Credit Card.
  • Debit Card.
  • Demand draft in favor of “APEDA” payable with respective cities

Generation Of Application Number

Once the payment is made an application number will be generated which can be required for future reference.

Issuance Of Login Details

On issuance of Registration Cum Membership Certificate, the login detail will be sent to the registered email ID of the exporter. The Exporter may login into their respective account through “Exporter Login” link given.

Status Check

An applicant can view the Status of the RCMC application by clicking the "Track Application" link and by submitting the IE Code and Application number until it is issued.

Re-Submission Of Documents

If there is any discrepancy in the application, the exporter will have to monitor and resubmit the document online.

Approval Of RCMC

The final Step is the approval of RCMC, and once the approval is granted the Certificate can be taken using APEDA Login under the heading of “View RCMC Certificate”.

What are the Penalties associated with APEDA Registration in India?

If any individual or person-in-charge who is responsible to a nodal agency to conduct the business of the nodal agency interrupt any officer of APEDA or any other person authorized by it to conduct inspection assigned by the APEDA, such individuals as well as the nodal agency shall be liable to penal action as prescribed by APEDA. Also, there are various conditions for imposing sanctions-

In Case Of Accredited Certification Bodies

    Non-Compliance

    Where after receiving delegation, an Accredited Certification Body is found to have deliberately provided any false or misleading information or document. *Here, ACB refers to Accredited Certification Body.

    Penalty For Non-Compliance

    A person shall be punishable with a fine extending upto Rupees Five Lakhs. Additionally, the authorization granted to the Accredited Certification Body may be discontinued and it may be disqualified from re-applying for accreditation for a period of 1 year.

    Non-Compliance

    If False information or documents have been provided by an applicant body looking for accreditation.

  • 4

    Penalty

    The application shall be rejected.

  • 5

    Non-Compliance

    If an ACB fails to comply with the standards prescribed under the NPOP.

  • 6

    Penalty

    Accreditation shall be suspended for a period extending up to 1 year and it shall be liable to a penalty, which may extend to Rs 500,000.

  • 7

    Non-Compliance

    If it is brought to notice that the certification of the operator was wrongly granted by an inadvertent Accredited Certification Body Certification shall be withdrawn and such delinquent Accredited.

    Penalty

    ACB shall be liable to compensate the operator for the damage caused to the extent quantifiable. Also, the NAB shall decide the compensation based on the facts and circumstances of each case.

    Non-Compliance

    Where an ACB fails to update and verify the required data on Trace.net relating to the organic production, area of the farm and movement of the products in the chain of custody.

    Penalty

    The penalty may extend to Rs 300,000.

  • 11

    Non-Compliance

    Where an ACB intentionally enters wrong data on Trace.net relating to the organic production, area of the farm and movement of the products in the chain of custody.

    Penalty

    The Penalty may extend to Rs 500,000.

  • 13

    Non-Compliance

    Where misrepresentation to the scope of the certification has been made.

    Penalty

    Penalty may extend to Rupees Three Lakhs (300,000).

    Non-Compliance

    If ACB fails to submit information within the prescribed time period.

    Application for accreditation may be rejected.

    Non-Compliance

    If an ACB commits a subsequent offence, whether of the same or similar nature as the previous offence or of a different kind

    It may extend to Rs 500,000.

In Case Of Operator

    Non-Compliance

    If a certified operator fails to comply with the standards prescribed under the NPOP.

    Penalty

    It may extend to Rupees Five Lakhs (500,000). Also, the certification may be withdrawn for 1 year.

  • 3

    Non-Compliance

    If non-compliances are established for the presence of residues of prohibited substances in the exported consignments.

  • 4

    Penalty

    It may extend to Rs 200,000.

  • 5

    Non-Compliance

    If the presence of residues of prohibited substances is repeated in the exported consignments.

  • 6

    Penalty

    It may extend to Rs. 500,000. Also, the exporter shall be banned for 1 year.

Collecting The Statistics Of The Establishments

When can the APEDA Registration be cancelled?

The registration can get cancelled in the following situations-

  • Providing the false information.
  • Violation of rules by the registering authority.
  • Contravention of conditions imposed in the certificate of registration.
  • Non-performance of export of the scheduled product for 12 consecutive months.
